The FDA announced that it has issued warning letters to 61 physical retailers for selling unauthorized vape products. The warning letters reference disposable vape products sold under the Elf Bar/EB Design and Lava brands.
The FDA states that these warning letters are based on long-term monitoring of multiple monitoring systems and their results. It aims to identify products that are commonly used by or popular among teenagers. Research results from the 2023 National Youth Tobacco Survey show that more than 50% of youth vape users said they use the Elf Bar brand. In 2023, the manufacturer of Elf Bar began to market the product under the name “EB Design”. Besides, the FDA reviewed the retail sales data and recent youth survey data. It has determined that the Lava brand is popular with teenagers.
These retailers who received warning letters violated the Federal Food, Drug, and Cosmetic Act. They sell or distribute vape products in the United States that are not authorized by the FDA. Recipients of warning letters are given 15 working days to respond. And they will need to correct the violation and prevent future violations in these days. Failure to promptly correct violations may result in further FDA action. For example, injunctions, seizures, and/or civil penalties.
These warning letters are part of the FDA’s ongoing efforts to address the marketing and sale of unauthorized vapes that appeal to youth. It includes previous warning letters issued to online retailers selling similar unauthorized vapes.
By now, the FDA has issued over 550 warning letters to retailers selling unauthorized vapes. And, they have taken more than 100 civil penalty actions.
